Judge dismisses Parikh case

EDISON — South Amboy Municipal Court Judge Joseph C. Hoffman Wednesday put an end to the eight-month-long criminal proceedings against Edison resident Rajnikant Parikh who was deported to India, his native country, last Thursday.

"The case is dismissed," Hoffman told a reporter.

Parikh was facing disorderly person’s charges stemming from a July 4 illegal fireworks display in Edison. He was held at the Middlesex County Adult Correction Center in North Brunswick after being arrested on Aug. 2 by the Immigration and Custom Enforcement officers. The arrest occurred during a rally at the Municipal Building to protest alleged police brutality by patrolman Michael Dotro during Parikh's July 4 arrest.

Dotro charged Parikh with aggravated assault on a police officer, resisting arrest, rioting and failure to disperse during the July 4 incident. The charges were later downgraded to disorderly person offenses by the Middlesex County Prosecutor's Office.

Edison Township Prosecutor Thomas Downs said Wednesday that the Immigration and Customs Enforcement bureau informed him on April 12 that Parikh was to be deported that evening. Downs said the township made no request to hold Parikh in this country while the criminal case was pending. "I have no jurisdiction in the Federal Government," Downs said. The case could not proceed without Parikh so Downs requested dismissal of the charges.

Ravinder Bhalla, Parikh's criminal attorney, said, if Edison had requested that ICE postpone Parikh's deportation because of the criminal charges, "ICE would have obliged."

ICE spokesman Adam Puharic said ICE had been in constant touch with Edison Township since Parikh was taken into ICE custody. "ICE was in communication with Edison Twp. to notify them of our intention to remove Parikh," Puharic said.

Bhalla contended, however, that "Edison avoided considerable embarrassment that would have resulted if the internal investigation files were released and we had a public trial in this matter." He said Parikh's deportation was a convenient way to eliminate the trial.

NEW JERSEY & ICE BROKE EVERY LAW, SPENDS $100,000 TO DEPORT 1 INDIAN

STATE OF NEW JERSEY & ICE OFFICE IN NEWARK VIOLATED US CONSTITUTION, PLEDGE OF ALLIGIANCE, THE BILL OF RIGHTS & MISUSE STATE & FEDERAL RESOURCES IN DEPORTING PARIKH

Unarmed handcuffed Rajnikant Parikh was brutalized under racial bias by Patrolman Michael Dotro in the presence of 30-40 residents for no apparent reason on July 4, 2006. Dotro falsely charged Mr. Parikh with aggravated assault on the Patrolman Dotro, tried to instigate 700-800 people to set up a riot, disobey the Patrolman, used abusive language for the Patrolman. (Constable in Indian Police) Patrolman Dotro in Aug. 2005 also brutalized 2 American Asian Indian businessmen and was cleared by the various racist departments of Edison and Middlesex County in Internal Affair investigations.

When Mr. Parikh was protesting along with few members of the Asian Indian community against Police Brutality under racial bias in the Municipal Complex of Edison on Aug. 2, 2006 he was arrested by Immigration and Custom Enforcement ICE on a more than 10 year old Deportation Orders of a Texas Judge. In 2003 he married to a US born Gujarati girl who is a second year medical student at present. On April 21, 2005 both appeared at the USCIS office in Newark and Mr. Parikh was allotted an A # 78824449.

Aug 2, 2006 Police Union PBA supporters/member’s family members in front of the TV and Press Media called the entire community of Indian origin, Cockroaches, Animals, Illiterates and illegal Go Home They also used racially derogatory statements, profanity and other offensive racial slurs against the entire community of Indian origin living in NJ.

There were 2 separate Internal Affair investigations ordered by the Edison Mayor Choi. After few months in a Press Conference he along with Police Chief said every thing was done properly and legally accept 2 junior officers (names not disclosed) failed to report about the ICE plans to arrest Mr. Parikh to their seniors and they will be given counseling. It was very obvious how a coded matter concerning security from Department of Homeland Security DHS can be concealed from the detective bureau. The fact is Police Chief George Mieczkowski who also has a brother Ronnie in the police force got the information. Mayor Choi, Chief Micezkowski’s and PBA President Michael Schwartz’s stand they were not aware of it is a very pathetic joke because a dispatcher has no ability to decode or is allowed to keep a coded message from DHS. Their fraudulent claims of not knowing were blown apart by Star Ledger in their Dec 2006 news that Mr. Parikh’s arrest was a result of the conspiracy by Patrolman Dotro accused of brutality and his brother Sam Dotro who works as an attorney for ICE in Newark.

Middlesex County Prosecutor Bruce Kaplan and Hester Agudosi Head of Bias Crime Unit from State AG Stubner’s office actively conspired with ICE Newark field office, Edison Mayor Choi, Police and Police Union to cover up the incident of Police Brutality under racial bias done to Rajnikant Parikh and his subsequent arrest by ICE in a conspiracy with local police. Governor Corzine, AG Stubner and Human Relations were approached on this issue on number of occasions. More than 2 dozen news articles in NJ, UK & India appeared in national and local News Papers including 2 major Indian TV channels on this issue still no one bothered to do justice to the victim Raj Parikh. From Aug. 2, 2006 Parikh kept on languishing in County Jail on immigration violation charges.

Finally on Feb 13, 2007 after deliberate, intentional & inordinate delays Municipal Judge Hoffman Ruled that both Internal Investigation reports concerning Parikh’s arrest on July 4th by Dotro and Aug. 2, 2006 by ICE be released to him with in 20 days. In an unprecedented move before the deadline of March 6, 2007, the Police Union PBA, which is not a government entity, but rather a private lobbying and collective agency for the private interest of individual police officers, a group neither vested with nor entrusted with the public interest, filed a motion seeking to intervene and making demands not to release the Internal Investigation Reports of victims arrest on July 4th & his subsequent arrest on Aug. 2, 2006 by ICE. Their demands were denied by Judge Hoffman.

NJ & ICE VIOLATED US LAWS 2

Police Union PBA moved to Middlesex County Superior Court. Superior Court Judge Robert Longhi is a very racist judge and he knew it he was retiring next month. In the matters of Parikh first he violated all notification rules by calling the victim's Counsel to be present in his Court the same day with in 2 hours and then he lied in the court about 2 incidents of 3rd party being allowed to intervene in the criminal trial and finally by ignoring State Prosecutor Abramowitz's objections that PBA police union has no standing, he stayed the release of Internal Affair investigation files to the attorneys of Mr. Parikh.

March 5th, 2007 must be treated as Black Day in the history of Courts in New Jersey where a retiring judge Robert Longhi knowingly lied in the court about intervention being allowed to 3rd party in criminal matters. “The right of a party to intervene in a criminal case is extremely rare and extremely circumscribed. Indeed, there is only one reported case in New Jersey that found such right. NJ Super 244 (Appell. Division 1995) a case involving a confidential informant in a homicide case. Knowingly Judge Longhi also ignored there are Federal Rulings United States vs. Richard Nixon 418 U.S. 683 (1974) and host of State Rulings that Internal Affair investigation files disclosure to the defendant in criminal matters are his rights for a fair Trial.

By denying Trial to Parikh in criminal matters the State of New Jersey and ICE field office in Newark has made a mockery of US constitution, Pledge of Allegiance and The Bill of Rights by those who are sworn to uphold it under all circumstances.

The Bill of Rights which applies to everyone, even illegal immigrant. An immigrant, legal or illegal prosecuted under criminal code has the Right to Due Process, a Speedy and Public Trial and Rights protected by the Fifth & Sixth Amendments. Mr. Parikh has been denied a Trial in the criminal matters arising out of his accusations of Police brutality under racial bias and cover up before being deported back to India for violating Immigration Laws of this country.

Moreover as per US Laws “Immigration proceedings are matter of Administrative Law, not Criminal Law. As a result, the consequence of Mr. Parikh violating his immigration status is not Jail but Deportation. Why ICE kept him in Jail under most inhuman conditions for almost 9 months and then became a conspirator to deny him a Trial for his pending Criminal Matters by deporting him when his victory in the Courts was a forgone conclusion?

Average cost to deport some one is $25,000.00 and in Parikh's case it is more than $100,000.00. In the matters of Mr. Parikh all US laws have been violated by those who are sworn to uphold them, just to save a WHITE RACIST PATROLMAN.

ICE OFFICER PERALTA CALLING HIS COLLEAGUE F…MEXICAN

This is the phone conversation between an ICE official and some one called "Sammy" in the presence of a detainee Rajnikant Parikh when his arresting Officer Peralta was taking him from Hemisphere Bldg in Newark to Middlesex County Correctional facility:

Officer Peralta was talking to some one "Sammy" "Subject is with me I can not talk much right now. It all depends on that Fucking Mexican." Aug. 2, 2006

Dec 21, 2006 Star Ledger published an article exposing conspiracy between Edison Police and ICE to cover up a case of Police Brutality under racial bias done to Rajnikant Parikh by patrolman Michael Dotro who has prior history of trampling his victims with boots from Indian origin along with a Gun pointing towards 13 witnesses the business owners of Indian origin. That time also Internal Affair investigation found him not guilty and the victims had to pay a fine for hanging Indian Flags for India Day Parade without a permit. In his 3 years of service he has 3 complaints against him.

Rajnikant Parikh recently saw that article and realized "Sammy" is Sam Dotro an attorney with ICE who is also the brother of Patrolman Dotro who brutalized him under racial bias on July 4th, 2006 and the Fu….. Mexican, Officer Peralta was referring to on Aug. 2nd, 2006 is his own Deportation Officer Ortiz, who is a Hispanic.

Rajnikant Parikh was arrested on Aug. 2, 2006 while demonstrating against Police Brutality with few children, adults and elderly members of his community on an 11 yr old deportation orders issued by a Texas Judge in his absentia in a conspiracy between local Police & ICE to hush up Police brutality under racial bias done to Parikh by Patrolman Dotro on July 4, 2006. This was done against the Town law, “that local police can not call Immigration & Custom Enforcement on its residents with a motive and especially without discussing with their Superiors.

Also on Aug. 2, 2006 entire community of Indian origin was called cockroaches, animals, illiterates and illegal go home by a white knuckle head group belonging to Police Union PBA members/their family members & supporters. These are the worst ever called Racial Slurs against this community in the history of America that too in the presence of Print & TV Media. They were also displaying posters, “If you act like animals, you will be treated like an animal.” People wearing T-Shirts, “welcome to America, speak in English now.” They were also shouting all kinds of racist remarks towards senior citizens, housewives, children and few adults from the Indian American community who were chanting, “We want justice, we are all children of the same God.”

Rajnikant Parikh is the victim of Police Brutality under racial bias by Patrolman Michael Dotro, Selective enforcement of Law under racial bias by ICE officers Sam Dotro & Peralta. Peralta also violated his freedom of Free Speech rights. Then he is the victim of conspiracy to cover all the above by Edison Mayor Jun Choi, PBA Chief Micheal Schwartz, County Prosecutor Bruce Kaplan and Bias Crime Head at Attorney General’s office Hester Agudosi.
Rajnikant Parikh was deported on April 14, 2007 under gross injustice just to save 1 white cop.
